Court Says Jury Should Decide if Tenant's Reports Were Sufficient

LOS ANGELES - A California appellate court has ruled that a jury should decide whether a tenant's reports of water intrusion - as required by the lease - constituted constructive notice to the landlord of possible mold contamination. White v. Indian Oaks L.P., et al., No. B208727 (Calif. Ct. App., 2nd Dist.).
The Court of Appeal, Second District, reversed summary judgment for Indian Oaks L.P., on March 18, saying that plaintiff tenant Steve White had raised sufficient facts to present the issue to a jury.
