NEW YORK - A landlord accused of failing to make timely repairs failed to provide sufficient documentary evidence to support its motion to dismiss a tenant's mold complaint, a New York appellate court affirmed on March 17. Reid v. Gateway Sherman Inc., No. 2008-04594 (N.Y. Sup., App. Div., 2nd Dept.).
The New York Supreme Court Appellate Division, Second Department, affirmed the ruling in favor of tenant Donna Reid on March 17.
Reid alleges that Renaissance Equity Holdings LLC, her landlord, failed to make timely and necessary repairs to her unit to prevent longstanding mold contamination.
