Texas Court Affirms Judgment for Apartment Complex Owner

DALLAS - A Texas appellate has ruled that an apartment complex owner was entitled to summary judgment because there was insufficient causation evidence to support mold property damage claims or personal injury claims by 62 tenants. Plunkett v. Connecticut General Life Insurance Co., No. 05-07-00614-CV (Texas 5th Dist. App. Ct., at Dallas).
The Fifth District Court of Appeals affirmed summary judgment for the owner and other defendants on claims by the 62 appellants in its Feb. 27 unpublished opinion, but remanded for further action on claims by 14 others.
