NEW YORK - Tenants in a New York apartment building have been barred from offering documentary evidence of mold testing, water leaks, or housing violations because of what a trial court said was willful unresponsiveness to discovery requests. Borrok v. Lisco Holdings, et al., No. 117074/2006 (N.Y. Sup. Ct., N.Y. Cty.).
The Feb. 24 order by Justice Martin Shulman of the New York County Supreme Court also ordered depositions to be completed by April 30 and scheduled a further compliance conference for May 5.
