NEW YORK - A New York trial court has ordered Greater New York Mutual Insurance Co. to share in the defense of an apartment complex accused of negligence in responding to water intrusion and mold problems during the insurer's policy periods. Atlantic Mutual Insurance Co. v. Greater New York Mutual Insurance Co., et al., No. 113846/2006 (N.Y. Sup. Ct., N.Y. Cty.).
The Feb. 25 order by Justice Michael D. Stallman of the New York County Supreme Court came on a motion for partial summary judgment by Atlantic Mutual Insurance Co., which has been funding the defense for their mutual insured.
