GEORGETOWN, Del. - A Delaware court has upheld a $5,220 verdict for homeowners who blamed their home's builder for shower leaks and mold, an appeal based on the statute of limitations for implied warranty claims and assertions of shared liability by the owners. Healy v. Silverhill Construction Inc., No. 06-03-030 (Del. Ct. Commn. Pls., Sussex Cty.).

Sussex County (Del.) Common Pleas Judge Kenneth S. Clark Jr. ruled for Sylvia T. and James V. Healy on Feb. 5, affirming the jury's finding of negligence against Silverhill Construction Inc.
