Court Affirms $55,000 Award for Statutory Warranty Claim

ST. PAUL, Minn. - A Minnesota appellate court has affirmed a jury award of $55,000 for a builder's breach of a home warranty statute, rejecting the homeowners' contention that jurors ignored much higher repair estimates. Noack, et al. v. Colson Construction Inc., et al., No. A08-0148 (Minn. Ct. App.).
The Court of Appeals also denied an appeal by the builders that the award be reduced by the 25 percent fault jurors apportioned to the owners for negligent repair. The court said that jurors accounted for apportionment of fault by awarding damages only on the statutory warranty claim.
