SAN FRANCISCO - A California appellate panel has affirmed a judgment for a condominium board accused of diverting settlement funds for other purposes and failing to make adequate repairs to prevent water intrusion in individual units. Calemine v. Jared Court Homeowners Association Inc., No. B200299 (Calif. Ct. App., 2nd Dist.).
California's Second Appellate District said in an unpublished opinion on Feb. 17 that the California Supreme Court has upheld the discretionary authority granted by unit owners to their boards.
