Post-Sale Inspection Report Supports Sellers' Disclosures

TROY, Mich. - A Michigan appellate court has affirmed summary judgment for home sellers after rejecting the buyers' assertion that their inspector's post-sale report of mold and hidden defects supports their fraud claims. Gabe, et ux. v. Vlk, et al., No. 28243 (Mich. Ct. App.).

The Court of Appeals said in its unpublished Feb. 3 opinion that the inspector's report, instead, supports sellers' disclosures and that without some evidence of fraud the buyers are bound by a release in the purchase agreement.
