Federal Court Denies RV Owners' Summary Judgment Motion

PORTLAND, Ore. - A federal magistrate judge has denied summary judgment to the owners of a recreational vehicle who sued the manufacturer over alleged defects that led to mold, saying the plaintiffs failed to show they are entitled to recovery under state law. Breniser v. Western Recreational Vehicles Inc., No. CV-07-1418-HU (D. Ore.).

But while Magistrate Judge Dennis J. Hubel of the U.S. District Court for the District of Oregon denied the motion by Jerry Breniser and Gale Thurber, he said in his Dec. 12 opinion that he would allow them to file a supplemental motion within two weeks.
