Minn. Arbitrators Rescind $495,000 Home Sale for Nondisclosures

MINNEAPOLIS - An arbitration panel has ordered home sellers to return $495,000 for a house that the buyer claimed was subject to undisclosed water damage and mold. Broeker v. Thorne, et al., No. 08-048-MN (Construction Arbitration Services).

The three-member panel also ordered Nov. 11 that the buyer be reimbursed for nearly $72,000 in costs related to the rescinded sale.

The award in favor of claimant Mary Broeker followed a one-day hearing on Sept. 17 under the auspices of the Construction Arbitration Services Inc., before arbitrators Gary Fuchs, Richard Beens and Ferdinand F. Peters.
