Camp Lejeune Plaintiffs Oppose U.S. Motion to Dismiss; Say Federal Circuits Now Split on Statute of Repose Issue

ATLANTA –– The plaintiffs asserting Camp Lejeune water contamination claims have opposed a motion to dismiss filed by the United States, contending, in part, that a recent decision has split federal courts on whether North Carolina’s statute of repose applies to latent diseases.
In a brief filed March 28 in the U.S. District Court for the Northern District of Georgia, the plaintiffs further argued that the defendant has failed to examine the various causes of action pled in the individual complaints.
