Camp Lejeune Benzene Appeal Involving CERCLA Preemption Tentatively Put on January Calendar




ATLANTA –– The U.S. Court of Appeals for the 11th Circuit has placed an appeal relating to whether CERCLA preempts North Carolina’s state statute of repose in the context of injuries caused by exposure to contaminated drinking water at the Camp Lejeune Marine Corps Base on its tentative calendar during the week of Jan. 13, 2014.

According an Aug. 22 online docket entry, the case was assigned to tentative calendar number nine in Atlanta during the third week of January.
