Exactech MDL Parties Select Bellwether Plaintiff from National Pool

NEW YORK — The parties in the MDL docket for cases involving Exactech orthopedic devices has selected Texas resident David Caputo, No. 23-1896, as a bellwether plaintiff from the national preliminary pool.

The May 3 letter was submitted in response to an order from Judge Nicholas G. Garaufis of the U.S. District Court for the Eastern District of New York.

The cases chosen for the first three bellwether trials are Tarloff, No. 23-5793 and Larson, No. 22-6643 — both from the Eastern District of New York pool — and , No. 23-658, from the national preliminary pool.
