BOSTON — A Massachusetts federal judge has denied GlaxoSmithKline’s motion for summary judgment in 50 cases on the Zofran multidistrict litigation docket, finding the plaintiffs presented sufficient evidence that the drug can cause orofacial abnormalities other than cleft palate.
In an Oct. 23 order, Judge F. Dennis Saylor IV of the U.S. District Court for the District of Massachusetts explained that testimony from the plaintiffs’ causation experts created a genuine dispute that Zofran can cause cleft lip with or without cleft palate.
