Talcum Powder MDL Judge Severs Medical Malpractice Claim and Remands, Retains Jurisdiction over Product Liability Claims

TRENTON, N.J. –– The judge overseeing the national multidistrict litigation docket for talcum powder claims has severed medical malpractice claims for a single case pending in the federal court, concluding that the claims would involve different expert opinions and evidence concerning causation.

In a Sept. 23 letter order, the U.S. District Court for the District of New Jersey rejected the plaintiffs’ efforts to keep the claims together, sending the medical malpractice cause of action against a local radiology company back to Kentucky but retaining jurisdiction over the product liability claims.
