Missouri Appellate Court Permits Appeal of $70 Million Talc Verdict to Proceed Despite Imerys Talc’s Bankruptcy Proceedings

ST. LOUIS –– A Missouri appellate court has ordered the appeal of a $70 million talcum powder ovarian cancer verdict to proceed despite Imerys Talc America’s recent bankruptcy filing, noting that the Johnson & Johnson defendants requested that the entire appeal not be stayed.

In a March 28 order, the Missouri Eastern District Court of Appeal stated that, “accordingly, the entire appeal is not stayed and the appeals of Johnson & Johnson and Johnson & Johnson Consumer Companies Inc. shall proceed.”
