Missouri Appellate Court Tosses $55 Million Talcum Powder Verdict, Says BMS Jurisdiction Precedent Applies to Claims

ST. LOUIS –– A Missouri appellate court has tossed a $55 million talcum powder verdict, finding that the U.S. Supreme Court’s personal jurisdiction decision in BMS controls the proceedings even though it was issued after the verdict was reached and while the appeal was pending.

In the June 29 opinion, the Missouri Court of Appeals for the Eastern District noted that the plaintiff conceded that the court lacked personal jurisdiction over the defendants, but asked the court to remand the matter “to allow her the opportunity to renew the case and present evidence of personal jurisdiction in light of the …
