Whittaker, Clark & Daniels Move to Dismiss Asbestos Cosmetic Talc Claims on Jurisdiction Grounds

TAMPA, Fla. –– Whittaker, Clark & Daniels has moved to dismiss an asbestos cosmetic talc suit on grounds that the court cannot exercise personal jurisdiction over the defendant since the contacts the company has with Florida are “insufficient.”

In the June 13 motion filed in the Florida 13th Judicial Circuit for Hillsborough County, the defendant argued that the decedent’s alleged injury “does not arise form or relate to any contacts between Whittaker and Florida, and thus, is insufficient to support the Court’s exercise of specific personal jurisdiction.”
