TRENTON, N.J. –– Plaintiffs who re-filed their talcum powder economic loss claims in state court in the wake of an MDL Court dismissing a similar class action suit have backed their decision to pursue their claims at the state level, saying the defendant had agreed to the dismissal of the former action under Article III.

In a May 31 letter to the U.S. District Court for the District of New Jersey, counsel for the defendants informed the MDL Court that the plaintiff that had originally filed the Mihalich class action suit had re-filed “nearly identical claims” in Illinois state court. …
