Imerys Talc America Challenges Jurisdiction, Says Florida Plaintiffs Can’t Rely on Florida’s Long-Arm Statute

TAMPA, Fla. –– Imerys Talc America has challenged jurisdiction in two recently filed talcum powder cases pending in Florida, contending that the plaintiffs cannot establish specific or general personal jurisdiction over the company.

In separate motions filed in Florida’s 7th and 15th Judicial Circuit Courts, the defendant further argued that the plaintiffs have failed to present enough facts to prove that jurisdiction can be asserted under the state’s long-arm statute.

The claims pending in the 15th Judicial Circuit Court for Palm Beach County were brought by plaintiffs Rosemary Ann Rossi and her husband, Richard Bourgelas. In that complaint, Rossi said …
