La. Talcum Powder Plaintiff Moves to Compel Discovery Responses from Imerys Talc America

NEW ORLEANS –– A talcum powder plaintiff with claims pending in Louisiana state court has filed a motion to compel discovery responses from Imerys Talc America, arguing that the defendant is attempting to “hide the ball,” in asserting that it does not have to respond to the requests since the court does not have jurisdiction over the company.

In a Feb. 6 motion to compel filed in the Louisiana Civil District Court for Orleans Parish, the plaintiff argued that a recent state appellate court decision establishes that nonresident party defendants are subject to the state’s subpoena authority.
