Florida Appellate Court Agrees to Hear Talcum Powder Defense Challenges to Jurisdiction Order

FORT LAUDERDALE, Fla. –– A Florida appellate court has agreed to hear the appeal of a lower court order rejecting Imerys Talc America Inc.’s efforts to dismiss talcum powder claims on grounds that the court could not exercise jurisdiction over the company since it is not at home in the state.
In a Jan. 8 order, the Florida Fourth District Court of Appeal said that after considering Imerys’ jurisdictional brief and the appellee’s response, it was opting to order sua sponte that the action “proceed as a non-final appeal pursuant to Florida Rule of Appellate Procedure 9.130(a)(3)(c)(i).”
