ST. LOUIS –– Plaintiffs whose $72 million talcum powder verdict was thrown out last month have asked the Missouri intermediate appellate court to rehear the dispute, maintaining that the case raises an issue of first impression.

In the alternative, the plaintiffs asked the Missouri Court of Appeals, Eastern District, to transfer the case to the Missouri Supreme Court for review.

In an Oct. 17 opinion, the Missouri Court of Appeals reversed the $72 million verdict, finding that the trial court did not have jurisdiction over the claims in light of the recent U.S. Supreme Court decision Bristol-Myers Squibb Co. …
