TRENTON, N.J. –– Talcum powder plaintiffs whose putative class action claims were dismissed by the court overseeing the national coordinated multidistrict litigation docket have filed a notice of appeal, contesting the MDL Court’s opining that the plaintiffs lacked Article III standing to bring the claims.

The plaintiffs filed the notice of appeal to the 3rd Circuit U.S. Court of Appeals on Sept. 9.

In July, the MDL Court granted Johnson & Johnson’s motion to dismiss the first amended complaint filed in the putative class action, but allowed the plaintiffs leave to amend.
