Talcum Powder Plaintiffs Oppose Personal Care Products Council Challenge to Jurisdiction in MDL

TRENTON, N.J. –– Plaintiffs with claims pending in the national coordinated docket for talcum powder claims have opposed the Personal Care Products Council’s motion to dismiss, saying that the defendant cannot seek a blanket dismissal of the cases because each Short Form Complaint does not specify individual bases for jurisdiction.

In the June 22 opposition brief filed in the U.S. District Court for the District of New Jersey, the plaintiffs further argued that “personal jurisdiction over PCPC can rest upon the existence of general personal jurisdiction, specific personal jurisdiction, conspiracy theory of personal jurisdiction or on all of the above.”
