Personal Care Products Council Challenges Talcum Powder MDL Claims, Says Jurisdiction is Lacking

TRENTON, N.J. –– The Personal Care Products Council has filed a motion to dismiss MDL cases pending against it, arguing primarily that the plaintiffs in the non-Washington, D.C., and New Jersey cases cannot establish jurisdiction.

For those that can establish jurisdiction, the PCPC told the U.S. District Court for the District of New Jersey in its May 19 motion, the claims are barred by a number of statutes, including the Noerr-Pennington doctrine and the anti-SLAPP statute.
