JPML Rejects Efforts from Talcum Powder Plaintiffs to Vacate Conditional Transfer Orders

WASHINGTON, D.C. –– The U.S. Judicial Panel on Multidistrict Litigation has denied motions by five talcum powder plaintiffs to vacate conditional transfer orders entered in the cases, reiterating that jurisdictional challenges “generally do not present an impediment to transfer.”

In an April 6 order, the JPML rejected the plaintiffs’ position that the Eastern District of Missouri should determine challenges to subject matter jurisdiction.

Plaintiffs in five talcum powder actions pending in the Eastern District of Missouri asked the JPML to vacate their transfer orders, maintaining that federal subject matter jurisdiction is lacking. The plaintiffs additionally noted that there motions …
