ST. LOUIS –– Imerys Talc America has opposed plaintiff efforts to stay a talcum powder lawsuit except for an evaluation of subject matter jurisdiction, saying that they are attempting to prevent the court from utilizing its discretion to determine personal jurisdiction before subject matter jurisdiction.
In the Jan. 26 response brief filed in the U.S. District Court for the Eastern District of Missouri, Imerys Talc said the personal jurisdiction in the instant case is straightforward, “and the Court should exercise its discretion to analyze that issue before addressing subject matter jurisdiction, if it concludes any jurisdictional issues should be evaluated …
