Talcum Powder Plaintiffs Move to Vacate Transfer Order, Say Claims are Due to Be Remanded

NEWARK, N.J. –– Plaintiffs whose claims were recently subject to a Conditional Transfer Order have moved to vacate the transfer of their lawsuit to the federal multidistrict litigation docket for talcum powder cases, maintaining that an order remanding their claims to state court is due any day now.

In the Dec. 13 motion to vacate CTO-7, the plaintiffs asked the U.S. Judicial Panel on Multidistrict Litigation to disregard the underlying action as a potential tag-along case, since it is not justiciable in any federal court.
