Talcum Powder Lawsuit Filed in Indiana State Court Removed; Defendants Cite Diversity Jurisdiction

INDIANAPOLIS –– Defendants named in a talcum powder lawsuit filed in Indiana state court have removed the case, arguing that diversity jurisdiction exists since none of the properly named defendants are residents of the state.

The defendants removed the case to the U.S. District Court for the Southern District of Indiana on Oct. 11.

Plaintiffs Amy Maurer-Martin and Ronald Martin filed the action in September in the Indiana Superior Court for Marion County. In the lawsuit, the plaintiffs alleged that Amy Maurer-Martin developed ovarian cancer as a result of using Johnson & Johnson’s Baby Powder and Shower-to-Shower.
