Missouri Plaintiffs Oppose Creation of Federal Talcum Powder MDL Docket

WASHINGTON, D.C. –– A number of plaintiffs have opposed the creation of a national multidistrict litigation docket for pending talcum powder personal injury claims, maintaining that their claims do not belong in federal court.

In an Oct. 11 motion to vacate the conditional transfer order, plaintiffs in Starks (16-01362, E.D. Mo.) argued that Johnson & Johnson’s removal arguments “have been swiftly rejected time and again by judges within the Eastern District of Missouri.”

The same plaintiffs filed an opposition brief to the creation of the federal docket on Oct. 7.
