EAST ST. LOUIS, Ill. –– An Illinois federal judge has denied Johnson & Johnson’s second attempt to dismiss a talcum powder class action lawsuit, finding that the plaintiffs had sufficiently outlined the “who, what, when, where, and how” in asserting claims under the Illinois Consumer Fraud and Deceptive Business Practices Act in their amended pleading.
In the same Sept. 20 order, the U.S. District Court for the Southern District of Illinois did toss the plaintiffs’ claims for injunctive relief, saying they lacked standing to seek such relief.
