Defendants Oppose Remand Efforts in Multi-Plaintiff Talcum Powder Suit, Say Courts Don’t Have Personal Jurisdiction over Non-Resident Manufacturers

ALBUQUERQUE, N.M. –– Defendants named in a New Mexico talcum powder lawsuit have opposed the plaintiffs’ remand efforts, maintaining that “courts do not possess personal jurisdiction over non-resident manufacturers as to claims by out-of-state plaintiffs that arose out of state.”

In a July 28 response filed in the U.S. District Court for the District of New Mexico, the defendants urged the court to address the issue of personal jurisdiction first before weighing in on subject matter jurisdiction.
