Johnson & Johnson Defendants Move to Sever, Dismiss Conspiracy and Fraud Claims in Talcum Powder Exposure Suit

OKLAHOMA CITY –– Defendants named in a multi-plaintiff talcum powder exposure suit have filed a motion to sever in Oklahoma federal court, maintaining that not only do the plaintiffs have different medical histories and experiences with the underlying products, but also bring different legal claims.

In a separate June 15 motion filed in the U.S. District Court for the Western District of Oklahoma, the Johnson & Johnson defendants additionally asked the court to dismiss civil conspiracy and fraud claims, saying that the causes of action are “based solely on cursory allegations that do not state a plausible claim.”
