Jury Must Decide Whether Parties Settled Superstorm Sandy Coverage Claims, N.J. Federal Judge Rules

CAMDEN, N.J. — A jury must decide whether a policyholder and an insurer agreed to settle Superstorm Sandy wind damage claims, a New Jersey federal judge has ruled, finding conflicting evidence as to whether the parties reached an agreement concerning repair costs.

On March 31, Judge Noel L. Hillman of the U.S. District Court for the District of New Jersey explained that if a jury finds that no enforceable settlement agreement exits, it must then determine whether the insurer breached the policy and did not act in good faith.
