OKLAHOMA CITY — An Oklahoma federal judge has awarded an insurer summary judgment in a tornado action, ruling that the carrier did not adjust the claim in bad faith and, in fact, paid the sum requested in the proof of loss, which the plaintiff accepted.
In a March 8 order, Judge David Russell of the U.S. District Court for the Western District of Oklahoma further held that the insurer’s delay in paying business income losses was reasonable, considering the plaintiff’s delay in providing the information needed to calculate the loss.
