Bad Faith, Fraud Claims Dismissed in Ky. Federal Tornado Property Damage Action

LOUISVILLE, Ky. — Bad faith claims asserted in a tornado property damage case must be dismissed because the plaintiff failed to allege that a policy covering property damage ever existed, and she admitted that the insurer has no obligation under her renters’ policy.

In a March 1 order, Judge David Hale of the U.S. District Court for the District of Kentucky also dismissed the plaintiff’s fraud claim, ruling that she failed to specify any fraudulent statements made by the insurer.
