PHILADELPHIA — A Pennsylvania federal judge has found for a homeowners’ insurer in a water damage action, ruling that the plaintiff failed to proffer sufficient evidence that wind damaged the roof of her home before forcing rain inside, as required by her policy.
In a Feb. 7 order, Judge Thomas O’Neill Jr. of the U.S. District Court for the Eastern District of Pennsylvania deemed credible a claim inspector’s testimony that openings in the plaintiff’s roof were caused by decay, rather than by wind or by tree branches that fell due to wind.
