Texas Federal Judge Remands Hailstorm Coverage Action, Says Claims Against Nondiverse Adjuster Viable

AMARILLO, Texas — A Texas federal judge has remanded a hailstorm coverage action to state court, ruling that the plaintiff has asserted viable claims against the nondiverse insurance adjuster, whom it accuses of conducting a substandard inspection of the damaged property.

On Nov. 9, Judge Mary Lou Robinson of the U.S. District Court for the Northern District of Texas found the allegations state a plausible claim against the adjuster because a reasonable person could believe that the facts and allegations, if true, would entitle it to relief under the Texas Insurance Code.
