NEW YORK — A New York federal magistrate judge has denied an insurer’s request for tax records in a Superstorm Sandy-related theft action, ruling that the documents are not relevant to the issue of whether the insureds claimed specific items as part of their business expenses rather than as personal property items.
In an Oct. 4 order, Magistrate Judge Cheryl Pollak of the U.S. District Court for the Eastern District of New York concluded that the tax forms do not contain sufficiently detailed information to aid in the analysis of plaintiffs’ theft claims
