DALLAS — A Texas federal judge has denied an insurer’s motion to dismiss a majority of the claims in a property damage coverage action, explaining that the insurer failed to specifically address in detail each of the claims it seeks to dismiss.
In a Sept. 15 order, Magistrate Judge Paul Stickney of the U.S. District Court for the Northern District of Texas denied the insurer’s motion with prejudice and ordered the plaintiff to file an amended complaint that addresses the deficiencies raised in the dismissal motion.
