NEW YORK — A New York federal judge has adopted a magistrate judge’s recommendation that a Superstorm Sandy coverage action be dismissed for lack of prosecution on the basis that the complaint was never served upon the defendant insurer and no action has been taken to move the case forward.
In a Sept. 15 order, Judge Nicholas Garaufis of the U.S. District Court for the Eastern District of New York noted that none of the parties had objected to the report and recommendation.
