DENVER — A property insurer is not required to pay for a general contractor’s overhead and profit arising from the repair of condominium roofs because the policyholder did not cooperate in the insurer’s investigation into whether a general contractor was necessary on the project, a federal appeals court has affirmed.
In a Sept. 9 order, the 10th Circuit U.S. Court of Appeals agreed with the trial court that by failing to assist the insurer in its investigation, the policyholder breached the terms of the policy, thereby barring coverage.
