TRENTON, N.J. — A New Jersey federal judge has upheld a magistrate judge’s order denying without prejudice a Superstorm Sandy plaintiff’s motion for an evidentiary hearing, ruling that it is not clearly erroneous or contrary to law.
On Sept. 1, Judge Stanley Chesler of the U.S. District Court for the District of New Jersey further held that the magistrate judge did not abuse her discretion in deciding that discovery should be completed before reconsideration of the plaintiff’s application for a hearing.
