Lawsuit Accusing Engineering Firm of Falsifying Superstorm Sandy Reports Dismissed Due to Pending Federal Action

MINEOLA, N.Y. — A New York judge has dismissed an action accusing an engineering firm of submitting falsified inspection reports to insurers that in turn were used as a basis to withhold Superstorm Sandy insurance benefits, noting there is a federal lawsuit pending between the same parties for the same cause of action.
On May 6, Judge Daniel Palmieri of the Nassau County Supreme Court held that both actions are based upon the same alleged wrong, and because the plaintiffs could have brought the causes of action in the federal action, the instant action should be dismissed.
