MINEOLA, N.Y. — A New York judge has dismissed a majority of the claims in an action accusing two engineering consulting firms and their employees of doctoring an engineer’s report in order to undermine a couple’s claim for Superstorm Sandy flood damage.
In a May 1 opinion, Judge Jerome Murphy of the Nassau County Supreme Court held that the plaintiffs’ claims of fraud, breach of fiduciary duty, violation of General Business Law Section 349, and professional malpractice were inadequately pled or do not apply.
