N.J. Appellate Court Upholds Enforcement of Settlement Agreement in Superstorm Sandy Coverage Case

NEWARK, N.J. — A New Jersey appellate court has upheld a trial court’s enforcement of a settlement of Superstorm Sandy coverage claims asserted against a homeowners’ insurer, finding the policyholders were fully aware of and understood the terms of the agreement.
On May 3, the New Jersey Superior Court, Appellate Division, further held that the policyholders were properly served with the pleadings in the enforcement action.
Kerline Jean-Francois and Marie Jean-Francois are sisters who jointly own a residence in Bloomfield, N.J. The property sustained damage on Oct. 29, 2012, when Superstorm Sandy hit landfall.
