Damage From Impact of Neighboring House Excluded Under Anti-Concurrent Causation Clause, N.J. Federal Judge Rules

TRENTON, N.J. — A New Jersey federal judge has awarded an insurer summary judgment in a Superstorm Sandy-related coverage action, ruling that the policy’s anti-concurrent causation clause bars coverage for damage caused by the impact of a neighboring house.

In an April 27 order, Judge Michael Shipp of the U.S. District Court for the District of New Jersey said the plaintiffs failed to present evidence that a storm surge did not cause the damage.
