Texas Appellate Court Upholds $334,739 Judgment to Plaintiffs in Hurricane Ike Damage Action

HOUSTON — A Texas appellate court has upheld a $334,739 judgment entered against an insurer in a Hurricane Ike damage action, ruling that the evidence supported the jury’s finding that the insurer breached the state insurance code.

On April 7, the Texas Court of Appeals, 14th District, noted that the insurer failed to assign any error to the plaintiffs’ insurance code claims.

Candelario and Maria Fuentes’ home sustained exterior damage during Hurricane Ike in September 2008.
